Terms of Service

These Terms of Service ("Terms") govern your use of Your Community Radio's hosting and management platform (the "Service"), operated by Jade WebArt ("we," "us," "our"). By purchasing or using the Service, you agree to these Terms.

1. The Service

Your Community Radio provides fully managed, branded internet radio station hosting, including a management dashboard, live broadcast tools, an ad marketplace, and related features ("the Platform"). We build and maintain the technical infrastructure; you are responsible for operating your station in accordance with these Terms.

2. Your Account and Station

You must provide accurate information when signing up. You are responsible for all activity on your station's account, including actions taken by any hosts, co-hosts, or staff you authorize. You must be legally authorized to represent the organization on whose behalf you register a station.

3. Content You Upload or Broadcast

You are solely responsible for all content uploaded, played, or broadcast through your station, including music, spoken content, advertisements, and any material submitted by hosts, co-hosts, or listeners. This includes responsibility for:

• Ensuring you have the legal right to upload and play any music or audio content;
• Obtaining any performance, mechanical, or synchronization licenses required to legally broadcast music publicly, including but not limited to licenses from performing rights organizations (such as ASCAP, BMI, or SESAC) and sound recording licensing (such as SoundExchange), where applicable to your station's operation;
• Ensuring content complies with applicable law and does not infringe any third party's intellectual property, privacy, or other rights.

We do not review, monitor, or pre-screen content uploaded to or broadcast through stations on the Platform, and we are not responsible for the legality, accuracy, or licensing status of any such content. Operating a public webcast may carry licensing obligations independent of where the content came from or who uploaded it; you are responsible for understanding and meeting those obligations for your station.

4. Copyright Complaints (DMCA)

We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act. If you believe content on a station hosted through our Platform infringes your copyright, submit a written notice including:

• Identification of the copyrighted work claimed to be infringed;
• Identification of the material you claim is infringing, with enough detail for us to locate it;
• Your contact information;
• A statement that you have a good-faith belief the use is unauthorized;
• A statement, under penalty of perjury, that the notice is accurate and you are authorized to act on behalf of the copyright owner;
• Your physical or electronic signature.

Notices should be sent to our designated agent: [Designated Agent Name/Title Pending Registration], contact@yourcommunityradio.com. We may remove or disable access to material in response to a valid notice, and we reserve the right to terminate accounts of repeat infringers.

5. Payment and Billing

Fees are billed monthly in advance through Stripe, plus a one-time setup fee where applicable, as described at the time of purchase. You authorize recurring charges to your payment method until you cancel. You are responsible for maintaining a valid payment method; failed payments may result in service suspension.

6. Cancellation

You may cancel your subscription at any time through your account's billing portal. Cancellation stops future billing but does not entitle you to a refund of amounts already charged, except where required by law or at our discretion.

7. Acceptable Use

You may not use the Service to broadcast unlawful content, harassment, or material that infringes others' rights. We reserve the right to suspend or terminate stations that violate these Terms or applicable law.

8. Disclaimer of Warranties

The Service is provided "as is." We do not guarantee uninterrupted availability, and we make no warranties regarding content uploaded by you, your hosts, or your listeners.

9. Limitation of Liability

To the maximum extent permitted by law, Jade WebArt is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including any liability arising from content uploaded or broadcast through your station.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
